Please read this Terms of Service ("Terms," "Terms of Service") carefully before using the VA Benefits Navigator Application (the "Application") operated by Veteran Success Solutions LLC, a Limited Liability Company formed in Florida, United States ("us," "we," "our") as this Terms of Service contains important information regarding limitations of our liability. Your access to and use of this Application is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone, including but not limited to visitors, users, and others who wish to access and use the Application.

By accessing or using the Application, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have our permission to access or use the Application.


Our Offers and Pricing

We offer services and digital products on this Application. The price of these services and digital products is customized based on your needs, which means that we will provide you with a quote after we determine your needs. This price does not include taxes or other fees that you may be charged.


Purchases

When you make a purchase on the Application, you will be able to choose the third-party payment processor that will collect your payment information and process your payment. You may make purchases using the following third-party payment processors: Google Pay and Stripe. We are not responsible for the collection, use, sharing, or security of your billing information by these third-party payment processors. The following payment method(s) are accepted by the third-party payment processors: American Express, Discover, MasterCard, and Visa.

You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information that you supply to us and to the third-party payment processor(s) is true, correct, and complete.


Cancellation Policy

We offer cancellations on purchases made of the services and digital products offered on our Application. Users can cancel their monthly or annual subscriptions at any time. You may cancel your order by contacting us and via the Application. You will not be charged a cancellation fee if you cancel your purchase in accordance with the instructions above. We will not be able to issue you a refund of the purchase price that you paid if you cancel your purchase.

We reserve the right to cancel your purchase for any reason, at our sole discretion, including but not limited to fraud, inaccuracies, and unavailability of the items or services purchased. We will let you know immediately if we plan on cancelling your purchase.

We do not offer refunds on any purchases made on this Application.


No Warranty on Purchases

The items or services displayed or sold on this Application are provided “as is.” No warranty, express or implied (including any implied warranty of merchantability, of satisfactory quality, or fitness for a particular purpose or use) shall apply to any items or services displayed or sold on this Application.


Remedies

You agree that the remedy for breach of this Terms of Service as it relates to your purchase shall be none. You also agree that the remedy for breach of this Terms of Service as it relates to your purchase shall be to pursue dispute resolution as provided in the “Governing Law, Severability, Dispute Resolution, Venue and Class Action Waiver” section below.


Subscriptions

This Application features products or services that are offered via a subscription model. A subscription model requires regular payments to receive a product or service. The initial term of the subscription is 1 month or 1 year, depending upon the plan the user chooses.

We do not offer the option to revoke your subscription shortly after making your purchase.

You must make a minimum purchase to qualify for the subscription. The minimum purchase required is as follows: 1 subscription license.


Automatic Renewals of Subscriptions

When you purchase a subscription on the Application, your subscription will automatically renew each year or each month, depending on the plan you choose. We will automatically renew your subscription by using the payment method on file until you cancel your subscription.

The cancellation of the automatic renewal of your subscription will become effective immediately upon you contacting us.


Accounts

When you create an account on our Application, you guarantee that you are 18 years of age or older and that the information that you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Application.

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to terminate your account at any time at our sole discretion. You can terminate your account by contacting us or through your account on the Application.


SMS Disclosure

By providing your mobile number and opting into SMS communications, you agree to receive text messages from VA Benefits Navigator. These messages may include, but are not limited to, notifications, marketing promotions, updates, transactional alerts, and account-related messages such as two-factor authentication (2FA).

Message Frequency: May vary based on your interactions and preferences.

Message & Data Rates: Standard rates may apply.

Opt-Out: Reply STOP to any message to opt out.

Prohibited Uses

You agree that you will not misuse the Application. The following is a non-exhaustive list of prohibited uses:

Impersonating or misrepresenting Veteran Success Solutions LLC, VA Benefits Navigator, or its employees

Sending spam or unsolicited communications

Engaging in conduct that harms or interferes with others’ use of the Application

Attempting unauthorized access or attacks (DDoS, malware, etc.)

Violating any applicable laws or regulations


No Warranty on Application

Replicating our proprietary content without written consent.

This Application is provided “as is.” No warranty, express or implied (including any implied warranty of merchantability, satisfactory quality, or fitness for a particular purpose) applies to this Application.


Availability, Errors, and Inaccuracies

We assume no liability for availability, errors, or inaccuracies of the information, products, or services provided on this Application. We reserve the right to correct any pricing or availability errors without prior notice.


Damages and Limitation of Liability

In no event shall Veteran Success Solutions LLC be liable for any direct, indirect, punitive, incidental, special, or consequential damages related to your use of this Application. If we are found liable despite this limitation, our maximum liability shall not exceed the service fees you paid to us in connection with the applicable transaction(s).

Governing Law, Severability, Dispute Resolution, and Venue

You and Veteran Success Solutions LLC agree that any claims shall be brought in your individual capacities only, not as a class action or other representative proceeding.


Changes to Terms of Service

We reserve the right to amend these Terms at any time. Updates will be posted to the Application without notice.

These Terms contain important information regarding your legal rights, remedies, and obligations, including various limitations and exclusions on our liability. Your access to and use of the Application is conditional upon your full acceptance of and compliance with these Terms. These Terms apply to everyone, including but not limited to visitors, users, and others who wish to access or use the Application.

By accessing or using the Application, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have our permission to access or use the Application.

2. User Accounts

2.1. Account Creation. When you create an account on our Application, you guarantee that you are 18 years of age or older and that the information you provide is accurate, complete, and current at all times. Providing inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

2.2. Account Responsibility. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept full responsibility for any and all activities or actions that occur under your account and/or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2.3. Account Termination. We reserve the right to refuse service, terminate accounts, remove or edit content at our sole discretion. You may terminate your account at any time by contacting us or through your account settings on the Application.

3. Purchases and Payments

3.1. Payment Processors. When you make a purchase on the Application, you will be able to choose a third-party payment processor (e.g., Stripe, Google Pay) to collect your payment information and process your payment. We are not responsible for the collection, use, sharing, or security of your billing information by these third-party payment processors. You agree to abide by the terms and conditions of any such third-party payment processor.

3.2. Authorization. You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information you supply to us and to the third-party payment processor(s) is true, correct, and complete.

4. Subscription, Billing, Cancellation, and Refunds

4.1. Subscription Services. We offer various subscription plans for our services (“Subscription”). By purchasing a Subscription, you agree to a recurring payment plan at the rates, and for the initial term, you selected at the time of purchase.

4.2. Automatic Renewal. ALL SUBSCRIPTIONS WILL AUTOMATICALLY RENEW at the end of your selected term (e.g., monthly or annually) for a successive period of the same duration at the then-current, non-promotional rate. You acknowledge and agree that we are authorized to use the payment method on file to charge you for the renewal.

4.3. Cancellation Responsibility. YOU ARE SOLELY RESPONSIBLE FOR CANCELING YOUR SUBSCRIPTION. You may cancel your Subscription at any time through your self-service customer dashboard within the Application. This is the preferred and most effective method of cancellation. As a courtesy, you may also request cancellation by emailing [email protected]. It is your responsibility to cancel your Subscription prior to the renewal date to avoid being charged for the next billing cycle.

4.4. Cancellation Effective Date. Cancellations are effective at the end of your current paid billing period. Upon cancellation, you will continue to have access to the service through the end of your paid term. For example, if your monthly subscription renews on the 15th of each month and you cancel on the 20th, you will have access until the 14th of the following month, and you will not be charged again.

4.5. No Refunds. ALL SALES ARE FINAL. We do not offer refunds or credits for any subscription charges that have already been processed. This includes, but is not limited to, partial-month refunds, refunds for months unused, or refunds for charges processed due to your failure to cancel before the renewal date.

4.6. Disputes. You agree to contact us at [email protected] to seek a resolution before initiating any chargeback or dispute with your bank or payment processor. Initiating a chargeback without first contacting us to resolve the issue may result in the immediate termination of your account and a permanent ban from all future services.

5. Prohibited Uses

You agree that you will not misuse the Application. The following is a non-exhaustive list of prohibited uses:

Impersonating or misrepresenting your affiliation with Veteran Success Solutions LLC, VA Benefits Navigator, or its employees.

Sending spam, chain letters, or other unsolicited communications.

Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of the Application.

Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Application, the server on which the Application is stored, or any server, computer, or database connected to the Application.

Attacking the Application via a denial-of-service (DoS) attack or a distributed denial-of-service (DDoS) attack.

Using any robot, spider, or other automatic device, process, or means to access the Application for any purpose, including monitoring or copying any of the material on the

Application.

Replicating, distributing, or reselling our proprietary content, software, or materials without our express written consent.

Violating any applicable local, state, national, or international law or regulation.

6. Intellectual Property

All contents of this Application, including but not limited to text, graphics, logos, images, as well as the compilation thereof, and any software used on the Application, are the property of Veteran Success Solutions LLC or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. All rights reserved. You agree to observe and abide by all copyright and other proprietary notices.

7. Disclaimer of warranties and limitation of liability

7.1. No warranty. The application and all services and products provided through it are provided on an “as is” and “as available” basis. We make no warranties, express or implied (including any implied warranty of merchantability, of satisfactory quality, or fitness for a particular purpose or use) with respect to the application or any products or services sold on it.

7.2. No guarantee of outcome. You understand that va benefits navigator is an educational platform. We do not guarantee any specific outcome or result from the use of our services, including but not limited to the approval of any va disability claim or a specific disability rating.

7.3. Limitation of liability. To the fullest extent permitted by law, in no event shall veteran success solutions llc, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the application. If we are found liable despite this limitation, our maximum liability shall not exceed the total service fees you paid to us in connection with the applicable transaction(s) in the six (6) months preceding the event giving rise to the claim.

8. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Application shall be resolved exclusively in a court of competent jurisdiction located in Hillsborough County, Florida.

You and Veteran Success Solutions LLC agree that any claims shall be brought in your individual capacities only, and not as a plaintiff or class member in any purported class action or other representative proceeding.

9. General Provisions

9.1. Changes to Terms. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post the updated Terms on this page and update the “Last Updated” date. Your continued use of the Application after any such changes constitutes your acceptance of the new Terms.

9.2. Severability. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

9.3. Entire Agreement. These Terms constitute the entire agreement between us regarding our Application and supersede and replace any prior agreements we might have had between us regarding the Application.
